We have heard Mr. J.J. Bhatt learned counsel on behalf of the appellant and Mr. S.H. Doctor learned senior counsel on behalf of the Board and find that the questions of law and fact which arise in this appeal are identical to those in Appeal no. 37 of 2008 which was allowed on March 31, 2008. Review Application no. 4 of 2008 filed in Appeal no. 37 of 2008 has been rejected by us today and for the reasons stated in our order dated March 31, 2008 allowing Appeal no. 37 of 2008, the present appeal also stands allowed. No costs.
