  1. This appeal is filed to challenge communication dated November 2, 2012

whereby Respondent has declined to give inspection of certain documents

which were sought by the Appellant.

  1. At the hearing of appeal today, learned senior counsel for Appellant

submitted that Appellant confines inspection in respect of eight documents as

per note furnished to this Tribunal on December 3, 2013.

  1. Counsel for Respondent on instruction states that although inspection of

some of the documents have been already given to the Appellant, without

prejudice to the contention that the said documents have no relevance,

Respondent is ready and willing to furnish copies of those eight documents

referred to in the note dated December 3, 2013 to the Appellant by Monday i.e.

December 23, 2013.

  1. In view of above, learned senior counsel for Appellant does not press the

appeal. Appeal is disposed of accordingly with no order as to costs.
